Intellectual Property, Confidential Designs and Rights Complaints Policy
Effective date: From the first publication of this version on b2b.scrolling.in, subject to the notice and existing-Order protections in the Marketplace Terms.
1. Purpose and scope
This Policy governs intellectual property in listings, RFQs, samples, technical documents, reviews, photographs, videos, software and other material on Burbn B2B. It also explains how a rights holder or authorised representative can report suspected infringement. The Marketplace Terms contain the common licence and confidentiality framework.
Copyright, trade marks, designs, patents, trade secrets and contractual confidentiality protect different interests. A complaint should identify the relevant right and facts; registration of one right does not automatically establish every other right or decide infringement in every territory.
2. Ownership and authority to submit material
You retain the rights you own. Before uploading or supplying material, obtain the permissions needed for the intended use, including photographs, drawings, logos, music, demonstrations, identifiable people and confidential documents belonging to another business.
Do not copy a competitor's catalogue, watermark, factory images or test report and present it as your own. Do not imply that a brand owner authorises your business merely because you resell genuine goods. Describe a lawful resale or compatible product accurately and without creating a false endorsement.
An employee or agency must have authority from the relevant business to publish its material. A licence to use content privately in a sourcing discussion does not necessarily permit public advertising, sublicensing or modification.
3. Limited licence to operate the Platform
By submitting material, you grant Burbn the non-exclusive, worldwide, royalty-free rights reasonably necessary to host, store, format, display, transmit, translate and distribute it for the Platform service and the audience you select. Burbn may permit its service providers to act for those purposes under appropriate restrictions.
Public product listings may be displayed in Platform search, previews and promotion of the listed goods. Separate paid endorsement, use of a person's likeness in a campaign, whitelisting or reuse beyond that scope requires the necessary separate permission. No ownership transfer or blanket waiver of non-waivable moral rights is created.
Burbn must not use editing or translation to materially change a product specification, invent an endorsement or falsely attribute content. Ordinary public use should end within 30 days after removal or account closure, subject to necessary transaction evidence, lawful archival retention and copies already lawfully received by others. Retaining a record is not permission for a new advertising campaign.
4. Private RFQs, drawings and technical information
Private RFQs, CAD files, bills of materials, samples, source files, negotiated prices and technical know-how are shared only for the authorised procurement or service purpose. They are not licensed for public advertising, resale to another buyer or general-purpose AI training simply because they were uploaded.
The recipient must restrict access to people and providers who need the information and are bound by appropriate obligations. Do not remove confidentiality markings or send a private drawing to additional Suppliers without the Buyer's authority. If wider distribution is needed for sourcing, agree the recipients or permitted group and any redactions first.
The confidentiality exceptions and duration in the Marketplace Terms apply. A separate NDA may provide additional protection. A recipient may retain limited records required by law or a genuine dispute hold without using them for new production or competitive exploitation.
5. Custom manufacturing, tooling and developed work
Before accepting a custom Order, record ownership of existing designs and know-how, rights in newly developed drawings or modifications, ownership of tooling and moulds, any exclusivity, allowed production quantity and the conditions for delivery of editable files or physical tooling.
Paying for goods does not necessarily transfer copyright, patents or design rights. Equally, possessing a Buyer's tooling does not entitle a Supplier to use it for another customer's production. Any intended assignment or exclusive licence must meet applicable legal formalities and be clearly documented.
A Supplier must not retain or sell unauthorised overruns, branded rejects or replicas in breach of the agreed rights. A Buyer must not instruct a Supplier to reproduce a third party's protected design without authority. If an IP concern arises, pause the affected work and seek an agreed lawful solution; do not conceal the issue until dispatch.
6. Brand, verification and certification marks
Use brand names and certification marks only to the extent legally permitted and accurate. A mark in an image or search keyword can still mislead. Do not copy Burbn branding to suggest you are the marketplace operator, its employee or its officially appointed importer.
A verification badge identifies only the actual verification described by Burbn. A laboratory logo or certificate must relate to the correct product, issuer and valid scope. Producing a forged certificate can involve fraud and safety issues as well as infringement.
7. Reporting suspected infringement
Send a notice to legal@scrolling.in, with grievance@scrolling.in available for formal escalation. A usable notice should contain:
- Your name, business where relevant, contact details and whether you are the owner or an authorised representative.
- Identification of the right, its owner and relevant territory; include registration details where applicable or a clear description and evidence of an unregistered right.
- The exact listing, media or account URLs or identifiers and enough detail to locate the material.
- An explanation of the alleged infringement, distinguishing the protected material from ordinary public facts or generic product features.
- Relevant supporting evidence, such as original publication, a licence limitation, comparison images or the specific protected patent claim where appropriate.
- A statement that the information is accurate to your knowledge after reasonable checking, that the complaint is made in good faith, and that you have authority to act; include a physical or electronic signature where required.
- The action requested and any court order, urgent safety issue or time-sensitive proceeding.
Do not include unrelated personal documents or disclose trade secrets unnecessarily. Where sensitive evidence is necessary, identify it as confidential and request a suitable restricted submission route. A notice that lacks a non-essential field will not automatically be ignored if the material and concern are otherwise identifiable.
8. Review and protective action
Burbn will record the complaint, assess its nature, seek proportionate clarification where needed and take action according to applicable law and the evidence. Possible measures include disabling specified content, pausing the affected listing, seeking a response, preserving evidence or referring the parties to a competent legal process.
The Grievance Policy governs applicable acknowledgement and resolution deadlines. Not every IP allegation falls within the accelerated category for other content-removal complaints. A qualifying court or authorised government order has its own mandatory route. An ordinary trade dispute does not become such an order because a claimant labels it urgent.
Where an applicable copyright statute or rule prescribes a notice, temporary-disabling or court-order process, that process and its conditions take priority. This Policy does not apply a US-style counter-notice or automatic restoration timetable to every Indian complaint, nor does it create a finding of infringement merely because content is temporarily restricted.
9. Notice to the affected user and response
Where lawful and appropriate, the affected user will receive enough information to understand the allegation and respond, including the relevant material, right and reason for the restriction. Contact or evidence may be redacted to protect privacy, confidentiality or an investigation while still allowing a fair response.
A response should identify the content and explain the claimed authority, ownership, licence, genuine-goods basis, applicable exception, mistaken identity or other defence, with supporting material. Do not resubmit the same disputed content under another account to avoid review.
Restoration depends on the evidence, law and any binding order. It is not automatic merely because the user disputes the complaint or the rights holder does not answer a non-statutory request. Conversely, a restriction must not be maintained without an adequate basis simply to pressure a user into a commercial settlement.
10. Misuse, repeated violations and appeals
Knowingly false ownership claims, fabricated evidence and complaints intended to suppress lawful competition may lead to proportionate restrictions and other lawful action. A good-faith complaint that is not upheld is not, without more, abuse.
Repeated substantiated infringement, evasion or counterfeiting may lead to listing restrictions, enhanced verification or account termination. The decision should distinguish credible findings from unproven complaint volume.
Either affected party may request internal review within 30 calendar days of the platform decision, identifying the error or new evidence. External legal remedies and statutory deadlines remain available. Burbn's review is not a substitute for a court's determination of title, validity or infringement.
11. Existing Orders and payments
An IP complaint may require affected stock to be quarantined or an Order paused. Buyers should receive an appropriate update without unnecessary disclosure of private evidence. If goods cannot lawfully be supplied, the Returns and Buyer Protection Policies govern the applicable refund.
A complaint does not automatically transfer disputed goods, tooling or Supplier funds to the complainant. Deductions, compensation and release of goods require a lawful contractual or judicial basis. Never require a Buyer to return counterfeit goods through an unsafe or unlawful route.
12. Records and contact
Relevant evidence may be preserved for the applicable legal period, a binding preservation duty or a justified dispute hold. Personal data and confidential technical documents remain subject to access restrictions and the Privacy Policy.
Rights notices: legal@scrolling.in. Formal complaints: grievance@scrolling.in. Private-data or impersonation complaints may also be sent to privacy@scrolling.in and follow the urgent route where applicable. Officer details and appeals appear in the Grievance Redressal and Contact Policy.
