Prohibited Products, Restricted Categories and Product Safety Policy
Effective date: From the first publication of this version on b2b.scrolling.in, subject to the notice and existing-Order protections in the Marketplace Terms.
1. Scope and allocation of responsibility
This Policy governs goods, samples, components, listings and sourcing requests on Burbn B2B. The Supplier is responsible for the legality, authenticity, safety and conformity of the goods it offers and supplies. The Buyer is responsible for the lawful use, import or resale obligations expressly allocated to it and imposed on it by law. Burbn remains responsible for its own marketplace duties and representations.
Applicable requirements depend on the goods, their classification, intended use, origin, destination, shipment date and the roles of the parties. A product lawfully sold in one country may require a different approval, label or licence in another. A commercial agreement cannot transfer a statutory responsibility to a party on whom the law does not permit it to be placed.
Approval to open a Supplier account, an accepted RFQ or a successful payment is not product certification. Category approval is limited to the goods, market and scope actually reviewed. The Shipping Policy governs import, transport and delivery allocation.
2. Goods prohibited on the Platform
Do not list, request, sell or knowingly facilitate:
- Stolen goods; counterfeit goods; unlawfully copied products; goods with deliberately altered serial numbers; or goods falsely represented as authorised branded stock.
- Illegal narcotic or psychotropic substances, controlled substances without the required authority, or equipment and instructions marketed for an unlawful purpose.
- Firearms, ammunition, explosives, improvised weapons and goods intended to facilitate violence. Lawful industrial tools are assessed according to their actual function and use, not merely their appearance.
- Products containing child sexual abuse material, non-consensual intimate material, unlawful surveillance content or another unlawful exploitation of people.
- Human organs or body parts, unlawfully traded biological material, protected wildlife or plants and their derivatives, or other goods traded in breach of wildlife or biosecurity law.
- Recalled goods that have not been lawfully remedied and released; goods known to present an unacceptable safety risk; or products whose sale, export, import or use is prohibited in the intended market.
- Falsified test reports, certificates, invoices, licences, identity documents, payment credentials, stolen personal datasets or access to compromised accounts.
- Products or arrangements designed to evade customs, taxes, sanctions, required certification, product labelling or a lawful platform restriction.
Burbn B2B also does not permit tobacco, nicotine vaping products, recreational intoxicants, gambling products or stand-alone financial or investment products under its ordinary goods marketplace terms. This Platform rule can be stricter than the law in a particular location. No implied exception arises because a similar product appears elsewhere online.
3. Restricted categories requiring express onboarding
The categories below may be listed only after Burbn has expressly enabled the relevant category and accepted the necessary verification for the specific Supplier and market. This Policy does not itself announce that any such category is currently available.
| Category | Matters that may need verification |
|---|---|
| Food, beverages, supplements and food-contact goods | Applicable food-business registration or licensing, ingredients, allergens, permitted claims, shelf life, storage, import and packaging requirements. |
| Medicines, medical devices and diagnostic goods | Product and establishment permissions, prescription or professional-use restrictions, device classification, permitted claims, traceability and import conditions. |
| Cosmetics, personal-care goods and chemicals | Ingredient and product restrictions, required registration or licences, warnings, safety information and transport classification. |
| Electrical goods, electronics, wireless devices and batteries | Applicable BIS or quality-control requirements, radio or wireless approvals where required, voltage and plug suitability, battery safety, transport documentation and environmental obligations. |
| Toys, protective equipment, machinery and industrial safety goods | Applicable compulsory standards, testing, conformity evidence, user instructions, guarding, commissioning and safety-critical limitations. |
| Pesticides, fertilisers, seeds, agricultural or biological products | Product-specific registration, permitted distribution, quarantine, labelling, storage and hazardous-goods requirements. |
| Precious metals, jewellery and high-value branded goods | Authenticity, applicable hallmarking and disclosure rules, title, valuation evidence and appropriate transport safeguards. |
| Used, refurbished, scrap, waste and recyclable goods | Accurate condition, remaining life, functionality, data erasure, environmental rules and any restriction on importing used goods or waste. |
| Dual-use or export-controlled technology | Classification, end-use and end-user requirements and any export, import or sanctions permissions. |
Where a product falls into more than one category, each applicable requirement must be addressed. Approval of a low-risk item does not extend to another model, power rating, ingredient, factory or destination requiring separate assessment.
4. Information required in a listing and final Order
Provide a clear product name, model or SKU, material or composition where relevant, dimensions, quantity unit, condition, intended use, essential warnings and the manufacturer or responsible business information required by law. Identify variant-specific differences and included accessories.
State country of origin and other legally required origin information accurately. Do not substitute a dispatch warehouse location for manufacturing origin. Identify shelf life, manufacture or expiry information, storage conditions and batch or serial traceability where material to safety or legal compliance.
Any certification or testing claim must identify its actual scope. “Certified”, “approved”, “food grade”, “medical grade”, “fire resistant”, “child safe” and similar claims require suitable evidence. A certificate for a different model or expired period does not substantiate the listed goods.
If a catalogue field says “Certification: None”, that does not waive a legal requirement or establish that no requirement applies. The Supplier must determine and disclose the requirements for the specific goods and destination before accepting the Order. Missing catalogue information must be resolved before a commitment that depends on it.
5. Compliance documents and checks
Where applicable, provide licences, registrations, test reports, declarations, authorisations, safety data sheets, batch records and other evidence requested for a legitimate compliance check. Documents must be complete enough to verify the issuer, product, relevant standard, validity and scope.
Burbn may check documents against issuing sources, request clarification, use an independent specialist or restrict the listing until the issue is resolved. These checks do not replace the Supplier's own compliance duties and must not be advertised as a broader independent certification than was performed.
Protect confidential technical information and personal data in submitted documents. Publicly display only required or appropriately authorised information. A Supplier may redact unrelated personal details if that does not prevent a necessary verification; an unredacted document, if required, should use a restricted channel.
Suppliers must comply with applicable labour, worker-safety and environmental laws in their operations and must not knowingly supply goods produced through unlawful forced labour, trafficking or unlawful child labour. Any claim about ethical sourcing, recycled content, sustainability or environmental benefit must have suitable evidence for its actual scope. A marketplace listing or verification badge does not constitute an independent supply-chain audit.
6. Samples, custom production and substituted materials
Samples must be identified as samples and be lawful to provide. A “sample” label does not automatically remove import, safety, labelling or tax obligations. An approved sample should be linked to the production specification, acceptable tolerances and the agreed testing method.
For custom goods, identify who owns the design, who supplies components, which party evaluates safety and which party completes required certification. A Buyer instruction cannot authorise unsafe or illegal production. The Supplier must raise a known compliance problem before manufacturing or dispatch.
Do not substitute a material, electrical component, formulation, factory, coating, safety feature or compliance-critical part without the required written approval and any necessary reassessment. A visually similar replacement may still change legal or technical compliance.
7. Labelling, packaging and transport
Meet the applicable packaging and product-information rules, including Legal Metrology requirements where they apply. Do not assume a B2B quantity automatically qualifies for an industrial or institutional exemption. The actual goods, packaging and transaction must meet the relevant conditions.
Supply warnings, instructions, safety data and installation information in the required language and format. Mark hazardous goods accurately and use lawful carriers, packaging and documentation. Do not conceal lithium batteries, aerosols, chemicals or another regulated item from a carrier.
Environmental duties may apply to producers, importers and brand owners under rules for batteries, e-waste, plastics or other products. Identify the actual responsible party and any necessary registration or extended-producer-responsibility arrangement. A delivery term alone does not discharge those duties.
8. International trade and importer responsibility
Before final approval, identify the importer of record, exporter, customs broker where appointed, agreed Incoterm and named place, responsibility for licences and approvals, duties and import taxes, and any required origin or conformity documents.
Do not promise “duty paid”, “free shipping” or “all inclusive” in a way that hides a charge or leaves the importer unidentified. If the Supplier cannot lawfully perform an agreed delivered-duty-paid obligation, it must resolve that before acceptance rather than force the Buyer to assume an undisclosed role afterwards.
Goods may be delayed, inspected or refused by authorities. Responsibility for the resulting cost depends on the cause, the accepted allocation and mandatory law. A Supplier remains responsible for false documents, undisclosed prohibited goods or its own compliance failure. The Buyer remains responsible for its own missing permission where that responsibility was properly allocated and disclosed.
9. Product warranties and performance claims
State the applicable warranty provider, covered goods, duration, start event, claim route, exclusions and service geography in the Approved Order Record. Avoid unsupported claims about lifespan, output, yield, compatibility, health benefits or safety.
A manufacturer's warranty does not automatically replace the Supplier's duty to deliver conforming goods. A commercial warranty exclusion does not excuse a misdescription, counterfeit goods or a non-excludable statutory obligation.
If equipment needs installation, calibration, inspection or commissioning, agree the required personnel, conditions, method and acceptance milestone. Do not use an undisclosed commissioning requirement to reject a timely defect claim.
10. Safety incidents and immediate containment
Notify support@scrolling.in and grievance@scrolling.in without delay if goods supplied or listed through the Platform may cause serious injury, fire, unlawful exposure or another material safety risk. Identify affected products, batches, Orders, known facts, proposed containment and the responsible contact. An initial report may be incomplete; update it as facts are established.
Stop affected sales and dispatch where needed, preserve relevant records, quarantine suspect stock and cooperate with necessary Buyer warnings and regulatory action. Do not wait for an ordinary three-Business-Day claim response when urgent containment is required.
Buyers should stop unsafe use, protect people, preserve suitable evidence and follow competent safety instructions. Do not test a dangerous failure merely to record a video. Contact emergency services for an immediate danger; the marketplace complaint route does not provide emergency response.
11. Withdrawals and recalls
The responsible Supplier, manufacturer, importer or other legally obligated party must carry out the required recall or corrective action. Burbn will take the marketplace steps required of it and support identification of affected Orders using lawfully available records.
A recall plan should identify the affected goods and batches, reason, risk, recipients, notice method, remedy, return or disposal arrangement, cost bearer and completion evidence. Warnings must be clear and must not conceal the hazard behind promotional language.
The party responsible under the Order or law bears the appropriate repair, replacement, refund, collection, testing and disposal cost. A safety return must not expose the Buyer or carrier to an avoidable hazard. Where ordinary return is unsafe or unlawful, use an authorised alternative.
Account closure, a prior settlement or expiry of an ordinary inspection period does not extinguish mandatory safety, traceability or recall duties. Do not resell recalled or unsafe goods without lawful remediation and any necessary clearance.
12. Traceability, records and inspections
Maintain records sufficient to connect products, batches and shipments to the relevant manufacturer, documents and Buyers where the category requires it. Preserve accepted specifications, material substitutions, test evidence and material safety communications for the applicable legal or justified contractual period.
An inspection must have a defined scope and respect confidentiality. Passing a sample test does not guarantee every unit, and a report must not be represented as covering untested attributes. A negative result should identify the method, applicable tolerance and affected quantity.
Personal data in compliance and recall records follows the Privacy Policy and applicable law. Keeping traceability records does not authorise unrelated marketing to the affected recipients.
13. Enforcement, remedies and appeal
Burbn may restrict a listing or category, pause affected transactions, request evidence, notify affected parties, cooperate with authorities or suspend a Supplier where justified. Urgent action may precede notice; provide reasons and a review route where law permits.
Buyer remedies follow the Returns Policy and Buyer Protection Policy. A product restriction is not permission to confiscate unrelated Supplier funds. Holds, deductions and recovery require the separate basis in the Payments Policy.
Internal review is available within 30 calendar days of a platform decision. Statutory rights, regulator powers and longer legal periods remain available. Contact routes and applicable urgent deadlines are in the Grievance Policy.
